General conditions ON ACCOMMODATION in Apartments Punta Creska 1 Punat

 

1. ContentS

Apartments Punta ensure accommodation services in accordance with the announced offer, information, description and date as well as with the confirmed reservation, except in case of force majeure (war, strike, terrorist attack, sanitary problems, natural disaster, intervention of competent authority, death or illness of the host).

 

2. RESERVATIONs and payment

If you would like to book an accommodation unit or if you need more information, please contact us by email, fax, mail or phone or come by in person.

With the reservation the guest confirms, that he/she is acquainted with the General conditions and that he/she accepts them. Everything stated in the General conditions is legally binding both, the guest and Apartments Punta.

When making a reservation the guest is obliged to provide all necessary information.

When making a reservation the guest is obliged to pay a deposit within a week according to the agreed way of payment. The rest of the payment for the accommodation has to be paid at least 30 days prior to arrival or on the day of arrival to the booked accommodation unit (it depends on the agreed way of payment for the reservation).

Credit cards are not accepted.

 

3. PRICE OF ACCOMMODATION

The price of accommodation includes the basic service described in the price list of the booked accommodation. Optional service is not included in the price and is marked extra (on agreement or advance notification) and has to be paid extra.

The prices are in euro. Apartments Punta have the right to change the price in case of major change of the exchange rate or change of the legislation. For all paid deposits for reservations Apartments Punta guarantee the price of accommodation stated on the confirmed reservation, when the guest paid the deposit.

In case that more people come into the accommodation unit than agreed and stated in the reservation, Apartments Punta have the right to send away the uninvited guests or it is also possible that the guests pay for the accommodation on the arrival day if the person in charge at the reception agrees. 

 

4. TOURIST TAX

The tourist tax is not included in the price and has to be paid extra together with the payment of the accommodation. (The Law on Tourist Tax of the Republic of Croatia)

Children until 12 are not obliged to pay the tax, young people from 12 to 18 pay just 50%. See tourist tax prices in the price list.

 

5. ACCOMMODATION AND SERVICE DESCRIPTION

The described and offered services and accommodation units are categorized according to the regulations of the competent institution. 

 

6. GUEST'S RIGHT TO CHANGES AND CANCELLATION

A reservation can be changed or cancelled only in written form by fax, e-mail or mail. The guest can change the number of guests or the arrival or departure date. This has to be announced 30 days prior to arrival. The first change of the reservation is free of charge, for all following changes of the reservation the guest pays 10 euro per change.

If finding alternative reservation is not possible and hence the guest cancels the reservation, the following cancellation charges will be considered:

·        15 days prior to arrival 35% of the accommodation price have to be paid (deposit will not be refunded).

·        14-9 days prior to arrival 50% of the accommodation price have to be paid.

·        8-2 days prior to arrival 80% of the accommodation price have to be paid.

·        1 day prior to arrival and if the guest does not appear or cancels within the booked term, 100% of the total cost have to be paid.

 

 

In case of cancellation due to force majeur the guest is obliged to provide a written report on the incident. In such case Apartments Punta will only charge the actual cost of the reservation cancellation, which is max 25% of the whole service value.

 

If the guest does not appear till midnight of the check-in day and he/she does not notify Apartments Punta, the reservation will be considered as cancelled and the costs charged as stated above.

If the actual costs exceed the above stated costs, Apartments Punta have the right to calculate the arised costs.

If the guest who cancelled the reservation finds a new guest for the same reservation, Apartments Punta charge only the costs caused by the change.

 

7. APARTMENTS' RIGHT TO CHANGES AND CANCELLATION

Apartments Punta have the right to change a reservation in case of special circumstances, which cannot be foreseen, avoided or eliminated.

An alternative accommodation can be booked just by previous notification of the guest. An accommodation of the same or higher category and the same price than the previously booked accommodation can be made available.

If a change is not possible, Apartments Punta have the right to cancel the reservation by advance notification of the guest at least 7 days prior to arrival. The whole paid amount will be refunded. If it is not possible to find a suitable alternative accommodation on the arrival day, we will give our best to provide the guest with information on nearest available accommodations. We will also refund the whole paid amount.

 

8. OBLIGATIONS OF APARTMENTS PUNTA

Apartments Punta are obliged to assure a smooth carrying out of the services and to take care of the rights and interests of the guests.

 

9. OBLIGATIONS OF THE GUEST

The guest has an obligation to:

·        own and provide a valid identity card at the arrival at the accommodation unit

·        respect the regulations of the state and the local community of the accommodation site

·        respect the house rules of the accommodation unit and to cooperate with the host with good intentions

·        show the host the voucher.

 

In case of not respecting the above stated obligations the guest bears responsibility for all costs and damages. With the reservation confirmation the guest is obliged to immediately pay the costs for possible damage (for example the damage of inventory).

 

10. LUGGAGE

Apartments Punta do not take responsibility for damaged luggage or stolen luggage as well as theft of valuable things, which were in the accommodation unit (we recommend to rent a safe). Lost luggage or thefts have to be reported to the host or police.

 

11. COMPLAINTS

If the guest is unsatisfied with the service, he/she can make a complaint to the host. The host is obliged to immediately take action to improve the service if it is possible.

Apartments Punta are obliged to take every founded complaint seriously and try to solve it as fast as possible.

 

12. COMPETENCE OF COURT

Apartments Punta are obliged to solve every dispute with reservation carriers or guests of the apartment house Punta by mutual consent. If this is not possible, the guest has the right to arbitration. For such cases the court in Rijeka is competent.

 

13. NOTE

With the paid deposit or with the total paid amount for the reservation of the accommodation unit the guest accepts all these conditions.
